A man applies for disability on his laptop while he and a woman are sitting on the couch. A wheelchair is seen next to them.

If a medical condition is preventing you from working, Social Security disability benefits may provide financial support. These benefits are designed to help cover basic living expenses, such as housing, utilities, and medical care when you are unable to earn an income due to a disabling condition.

People apply for SSDI (Social Security Disability Insurance) when they’ve worked and paid into Social Security but can no longer work because of a significant illness or injury. Qualifying for these benefits can be challenging, and the process often requires detailed documentation and an understanding of eligibility requirements. Working with a Sharon Social Security disability lawyer can help you manage the application process and strengthen your case.

If you have a disability, you deserve an attorney who fights for the benefits you are legally entitled to under Massachusetts law. Attorney Jim Glaser and his team can help.

Answering Your Massachusetts Disability Benefits FAQs

When it comes to Massachusetts disability benefits, you probably have a lot of questions. The good news? Jimmy Knows!® the answers. Whether you’re wondering about eligibility, denials, application steps, or what you may be entitled to, Jim Glaser Law is here to help you find the information you need. Explore our answers to some of the most common SSDI questions below.

Do you have to be unemployed to receive disability benefits?

No, you don’t have to be fully unemployed to qualify for Social Security Disability benefits, but there are income limits. In 2025, if you earn more than $1,620 per month from work (for non-blind individuals), Social Security will generally consider this as “substantial gainful activity” (SGA), making you ineligible for SSDI. For individuals who are statutorily blind, the SGA limit is higher, at $2,700 per month. Limited work that stays below these thresholds may still be allowed. Consulting a disability lawyer can help you understand how part-time work could affect your eligibility.

How many work credits do you need to qualify for disability benefits?

To qualify for SSDI, applicants generally need 40 work credits, but younger individuals may qualify with fewer credits: those under 24 need 6 credits from the last 3 years, those aged 24-31 need credits for working half the time between age 21 and their disability start, and those 31 or older typically need 20 credits from the last 10 years.

The amount of earnings required to earn 1 credit can change yearly. For 2024, 1 credit is awarded for every $1,730 in covered earnings, meaning you’d need $6,920 in income to earn the maximum 4 credits for the year. This income-to-credit ratio may adjust annually, so it’s a good idea to check current guidelines or consult with a Sharon Social Security disability lawyer to confirm your eligibility.

How much will you receive in disability benefits?

Your Social Security disability payments are based on how much you earned during your highest-paying work years. The Social Security Administration (SSA) looks at your average monthly earnings and applies a formula to decide your monthly benefit amount. Generally, the more you earned and paid into Social Security, the higher your benefits may be, but there is a maximum limit.

Various factors can influence your payments, including any other income you receive, such as workers’ compensation. Working alongside an attorney can help you understand what benefits you are entitled to and can help you maximize your monthly payments.

What is SSI (Supplemental Security Income)?

Supplemental Security Income (SSI) is a federal program that provides monthly payments to individuals with limited income and resources. SSI is different from SSDI because it is based on financial need rather than work history. This program is available to adults and children who are disabled, blind, or over the age of 65 with limited financial means. For children, SSI can help families cover basic needs if the child has a serious disability. Eligibility is determined by the SSA based on both income and assets.

A lawyer can help you understand whether you should apply for SSI, SSDI, or even both.

What is the SSA’s Blue Book, and how does it impact eligibility?

The SSA’s Blue Book, officially called the Listing of Impairments, is a guide that outlines specific medical conditions and criteria used to evaluate disability claims. The Blue Book includes listings for both adult and childhood disabilities, each with detailed requirements that help the SSA decide if a condition qualifies as a disability. To be eligible for SSDI or SSI, applicants must either meet the exact requirements in the Blue Book or show that their condition is as severe as a listed impairment. If an applicant’s condition matches or equals a listing, it can make the approval process faster and more straightforward.

What is the maximum fee a disability lawyer can charge?

For fee agreements approved on or after November 30, 2022, federal law caps the fee a lawyer can charge for helping you obtain SSDI benefits at 25% of your past-due benefits, with a maximum limit of $7,200. At Jim Glaser Law, we believe in transparency, so you’ll know exactly what you’re paying from the start. It costs nothing to hire us, and we offer free consultations to discuss your case. You only pay a fee if we help you win your benefits.

How can an attorney assist with a disability claim?

A disability attorney in Sharon, MA, can provide valuable support throughout the entire disability claim process. Here’s how they can help:

  • Filing Correctly: Your attorney ensures that your application is complete, accurate, and submitted with all the required documentation, helping to avoid common mistakes that lead to delays or denials.
  • Appealing Denied Claims: If your claim has been denied, an attorney can guide you through the appeals process, gathering additional evidence and presenting a stronger case to improve your chances of approval.
  • Maximizing Benefits: A lawyer can help identify any additional benefits you may qualify for and work to secure the maximum amount you’re entitled to under the law.
  • Improving Approval Chances: Attorneys are familiar with what the Social Security Administration looks for, so they can strengthen your case by making sure it meets all necessary criteria.
  • Handling Communication: Your lawyer communicates with the SSA on your behalf, managing requests and ensuring that deadlines are met, so you don’t have to navigate the complex process alone.
